POLICIES, TERMS, AND CONDITIONS OF INCA'S PARADISE

INCA'S PARADISE TRAVEL AGENCY appreciates your preference; we will make your trip the best moments of your life. We kindly ask you to carefully read our policies, terms, and conditions:

  1. Documentation

    To confirm your reservation, it is mandatory to pay a 50% advance of the total cost, and the remaining 50% on the day your tour or tourist packages begin.

    It is mandatory to send a legible copy of the passport valid for more than 6 months. You must also send a copy of the immigration stamp with the entry date to the country (from your trip). INCA'S PARADISE will not be responsible for expenses due to inappropriate documents, expired documents, or lack of travel documents.

    For foreigners residing for more than 60 days, an additional 18% (IGV) of the contracted program value will be added.

    Family groups with children must carry their passport or ID. If traveling alone with one parent or guardian, you must present a notarized permission with parental authorization. Failure to present this documentation after payment will result in the denial of service and a 100% penalty.

    University student discounts for entry to the Inca Trail and Machu Picchu require a valid undergraduate student ID up to 25 years old, issued by the university containing the following: university information, student's personal information, student photo, and validity date not exceeding one year from the entry date to these two attractions (scanned submission by email) and must be carried for the start of the tour.

  2. Holiday Dates

    In case of holidays in various destinations in Peru such as Christmas, New Year, Independence Day, Easter, Cusco festivals, among others, an additional fee will be applied according to the policies of our suppliers.

  3. Travel Insurance

    Before embarking on any trip, we recommend obtaining travel insurance covering accidents, medical expenses, and emergency repatriation, or even rescue or air ambulance. We also recommend including tour cancellation and luggage loss coverage in your insurance. You can send us a scanned copy of your policy to our email or entrust a copy to a trusted family member or friend.

  4. Domestic Flight Reservations

    Once the airline tickets are issued, they are non-refundable and non-transferable, but can be rescheduled subject to availability and penalty.

  5. Reservations

    To make a reservation, the company requires the client to pay 50% of the total tour amount using our authorized payment methods sent by the sales agent. The remaining 50% of your tour must be paid in cash on the first day of your arrival at the chosen destination in US dollars to the assisting staff.

    For reservation confirmation, the following information for each traveling passenger is required: a copy of their passport showing Full Name, Passport Number, Nationality, Age, Gender, and the page showing the entry stamp to Peru.

    It is recommended to inform if you have any allergies, illnesses, passenger conditions, passenger characteristics, food preferences, etc.

    Once the prepayment is made, our sales agent will send you an email confirming the reservation of the tour and/or tourist package chosen by the client. This email is a guarantee document of your reservation, after receiving the confirmation, the client must check the content of the email in detail and respond to it.

    If your reservation includes accommodation nights, hotel confirmations are subject to availability. If there is no space in the specified hotel in the confirmation email, the client will be given another of similar category and price. Likewise, in the case of early check-in and late check-out, an additional fee will be applied according to the hotel policies.

    To reserve packages that include a visit to the MACHUPICCHU Sanctuary, the company reserves the right to accept last-minute reservations or when the entries to it have been exhausted. If the reservation is received, the company will expressly indicate the special conditions of said reservation, which will include, if applicable, special schedules. These conditions must be mutually agreed upon with the client and will be evidenced by email.

  6. Cancellations, Refunds, and Reimbursement

    All passengers are subject to a charge for cancellation and/or postponement of the requested service:

    • Tour Reservation (1, 2 and 3 days)

      If a cancellation request is received 15 days before your trip or 05 days or more after confirmation is sent, it will be subject to a penalty for operational expenses of 30% of the tour price.

      If a cancellation request is received 72hrs. before your tour, it will be subject to a penalty for operational expenses of 50% of the payment made, which is non-refundable.

      Refunds are made through the same payment method used, within the next 15 days. The penalty must be considered, in addition to the financial expenses associated with the cost of flight tickets, bank transfer, credit card commission, and any other expense and/or cost associated with the refund.

    • Tour Package Reservation

      If a tour package cancellation request is received 45 days before your trip or 05 days or more after confirmation is sent, it will be subject to a penalty for operational expenses of 30% of the package price. Outside the financial expenses associated with the cost of flight tickets, bank transfer, credit card commission, and any other expense and/or cost associated with the refund.

      If a tour package cancellation request is received just 15 days or 72 hours before your trip, there will be a 100% penalty.

      If in a group a passenger cancellation request is made and a replacement reservation is desired, this condition is not applicable.

      In case you have booked inclusive services such as: Hotels, Flights, Buses, Trains; you will adhere to the conditions and rules that those companies have, as mentioned above. This rule also applies to tourist places with high traveler influx, such as the Inca Trail.

      Likewise, no refund or reimbursement will be granted for the tourist's absence on the tour, flight losses due to passenger tardiness, or cancellation during the trip. There is no refund or reimbursement for unused portions of tourist packages or stays.

      In the event of cancellation of tour packages that include hotel, bus, and/or train services already issued, no refund or reimbursement will be granted for these services. On the contrary, for card payments, a 10% penalty is included in all cases.

      Certain services may be interrupted or canceled due to weather conditions, force majeure, disturbances, etc., or other factors beyond the control of hotels, airlines, suppliers, or the agency itself. No refund or reimbursement will be granted as a result of these interruptions or cancellations beyond our control.

      During the high season period, our company reserves the right to alter cancellation policies if our suppliers apply different penalties than those listed above, as provided for in Art. 1277 of the Current Peruvian Civil Code.

      Any modification or cancellation must have the acceptance of our Reservations Department (in writing). Otherwise, it is not considered valid.

    • No Show

      Any passenger who does not show up for a scheduled and reserved service, without prior cancellation and acceptance, will be considered a NO SHOW, and 100% of the fare will be charged without the right to refunds or claims.

    • Operational Expenses for Tickets and Trains

      In the case of a tour to Machu Picchu, entry to Wayna Picchu, Machupicchu mountain, Machu Picchu have a complete penalty, so there is no refund for these expenses, these are policies established by the Ministry of Culture.

      Also, train tickets have an additional penalty of 20% of the original ticket value, these are policies established by INCA RAIL and PERU RAIL.

  7. Pickup Schedule

    The pickup time will be determined in the program; the tourist must be ready and waiting in the hotel lobby. If the tourist is not ready at the established time, the agency will not be responsible for delays and/or abandonment by the transport, as this is an already established schedule. If the tourist is found to be highly intoxicated, the tour will be canceled without the right to reimbursement or rescheduling.

  8. Hotels

    The company reserves the right to substitute hotels of the same category in the tourist packages it offers, this is because INCA’S PARADISE is subject to hotel availability in Peru, as provided for in Article 1277 of the Current Peruvian Civil Code.

    In the case of early check-in and late check-out, an additional charge will apply according to the hotels' policies.

  9. Inca Trail, Huayna Picchu Mountain and/or Machu Picchu Mountain

    These services are considered within the adventure tourism category, they have governmental restrictions due to their maintenance, protection, and conservation, so the reservation must be made well in advance and subject to availability of spaces, these services are highly demanded and have a limited number of spots available.

  10. Updating Information on Our Website

    The company reserves the right to modify any information contained on our website.

  11. Losses and/or Theft of Belongings

    During the development of your program, INCA’S PARADISE will not be responsible for the loss of your belongings, suffering theft or damage to luggage, to avoid this we strongly urge you to be attentive to all your belongings.

  12. Flights / Delays

    We cannot accept any responsibility for cancellations or delays in any of your flights, if the cancellation or delay is due to adverse weather conditions, rescheduling by the airline, airport authority and/or action by air traffic controllers, mechanical failures or industrial action.

    Our company will strive to resolve your travel itinerary, and ensure that any inconvenience caused by air delays is resolved and nothing is affected.

    The Customer must understand and be flexible if due to an air delay the problems cannot be resolved.

  13. Children Policy

    In all programs, unless otherwise indicated, the maximum age for a child is 11 years and 11 months. Those over 12 years old are considered adults and will be subject to adult rates.

  14. Privacy Policy for Personal Data Use
    • Purpose of this policy

      The purpose of this policy is to inform how INCA’S PARADISE protects and handles the personal data of customers, passengers, suppliers, tour operators, travel agencies, and collaborators, from its collection through various channels, whether physical or digital, for the purposes duly communicated.

    • General Information

      Inca’s Paradise, a company that offers individual and group trips, land tours, organizes tours or excursions, arranges accommodation, and performs any other activity directly related to tourism. For this purpose, information is collected, used, managed, transferred, stored, and processed, which may be associated with information belonging to natural persons in the development of their activities. For example: name, identity document, phone number, email address, country of residence, among others, through various physical and digital formats.

      The collected and stored information includes basic data entered through registration forms, contact forms, or similar; such as, for example, name, ID, passport, gender, age, phone number, email address, country of residence, among others, data collected through the various channels managed by the company, necessary for the provision of Inca’s Paradise tourism services. In any case, users will be able to see which ones are essential for the correct provision of the service and which ones will have an accessory character before sending their personal data.

      The user will be solely responsible for the truthfulness and accuracy of the data provided. Only those over 18 years of age and/or those with sufficient legal capacity may be users. Likewise, the user will be solely responsible for the data provided by third parties, as well as for guaranteeing that they have been informed of this Privacy Policy and have obtained their express consent.

      Inca’s Paradise, in accordance with Law No. 29733 - Personal Data Protection Law - and its Regulation No. 003-2013-JUS, authorizes and grants to INCA’S PARADISE, indefinitely, my free, prior, express, unequivocal, and informed consent for it to (on its own): Collect, process or delete, transfer or import, export my personal data, to create Databases, transfer them LINKED TO INCA’S PARADISE.

    • (Whether commercial partners or not, national or foreign, public or private) for the purpose of:

      I. Provide me with the requested service.

      II. Inform me about new services related to the acquired service(s).

      III. Establish communication to provide me with information related to the service provided, for offers, promotions, advertising, partnerships, among others, contests and content that may be of interest to the owner of INCA’S PARADISE and/or any other company that belongs to or may belong in the future to INCA’S PARADISE, domiciled or not in the country.

      IV. Evaluate the quality of the services provided.

      V. Conduct customer satisfaction surveys, store and process my personal data for statistical and historical purposes for INCA’S PARADISE and/or third parties linked to it and/or any other company that belongs to or may belong in the future to INCA’S PARADISE.

    • I have been informed that:

      I. If I do not grant this consent, my information will only be used (processed) for the execution (development) and fulfillment of the service I contract.

      II. I may revoke my consent at any time by communicating my decision in writing to any of INCA’S PARADISE offices or through social media, which will not affect the use of my data or the content of the Databases for the execution and fulfillment of the transaction I enter into with you.

      III. I may exercise my rights of access, rectification, cancellation, and opposition to my data in accordance with current legislation.

      IV. Security and Conservation of personal data

    Inca’s Paradise complies with the legally required personal data protection measures and has adopted reasonably required measures according to current technical knowledge and good practices for the custody and management of information in order to prevent loss, misuse, alteration, illegitimate intrusion, and theft of personal data provided by users. Likewise, data collected from users such as photographs and videos will only be used for tour promotion, marketing, advertising, and market research.

    The periods of conservation of users' personal data until the user requests the cancellation of their use by Inca’s Paradise. Likewise, users understand and accept that certain personal data must be retained by Inca’s Paradise, due to legal regulations and according to deadlines established in the legislation.

  15. Modifications to the Policy

    Inca’s Paradise may make changes and update this policy based on legislative, jurisprudential, and/or institutional needs, among others; therefore, users are advised to review this policy regularly and/or each time they access the company's website.
